This webinar focused on what possible directions what the ideal paths lie for a US/Kenya Free Trade Agreement that will benefit Kenya in all the areas it is negotiating with the United States. The experts panelists consider what constraints and possibilities the negotiating framework in the United States means for Kenya’s goals in the negotiations. In addition, the experts consider what lessons Kenya can learn from the United States, Mexico and Canada, (USMCA), Free Trade Agreement and how those lessons can translated into positive outcomes for Kenya.

Doves, Vultures and African Debt in the Time of COVID-19

To mitigate the risk of speculation, I have proposed  that the international community should create a Debts of Vulnerable Economies Fund (a “DOVE” fund) to help African countries deal with their private sector debt. The fund could be created by an African institution such as the African Development Bank or the African Union. The fund should be financed by governments, foundations, financial institutions, companies and individuals. In order to demonstrate its independence from both debtor countries and creditor institutions it should be managed by an independent board representing all stakeholders.

Proposed Solutions for Sub-Saharan Africa for Food and Agriculture in the Context of COVID-19

The shortcomings of the current legal and policy framework does not mean that responses to COVID19 should be lacking. Instead, there is adequate room for responses as we learn lessons and take notes to do better. The best way to move policy and law is to ensure that it is constantly reviewed to make sure they serve their purpose.

PEPA/SIEL Conference, UNCTAD/SIEL Award for Research in Investment & Development

The conference is organised by the Postgraduate and Early Professionals/Academics Network of the Society of International Economic Law (PEPA/SIEL) in collaboration with the International Law Forum and other sponsors at the Hebrew University of Jerusalem. SIEL’s Postgraduate and Early Professionals/Academics Network (PEPA/SIEL) is, among other things, interested in fostering collaboration and mentoring opportunities for emerging academics and professionals in International Economic Law (IEL). PEPA/SIEL fulfils these goals through various activities such as organising conferences at which emerging IEL academics and professionals can present and discuss their research in a supportive and welcoming environment.

The Missing Voice of Caribbean States in the Ongoing Debate on WTO Dispute Settlement Reform

In my view, one simple and safe guiding principle for Caribbean states could be whether the proposals on the table advance or diminish the protections guaranteed by the rule of law.  These protections include: supremacy of law, equality, accountability, fairness, separation of powers, participation in decision-making, certainty, avoidance of arbitrariness and procedural and legal transparency.  Using this as the guiding principle, small states can meaningfully contribute to the debate.

An African Response to WTO Reform Proposals

The lack of participation of African states in the WTO dispute settlement system is indicative to a certain extent of the discomfort that most African states feel vis-à-vis the said system. A future reform of the DSU must necessarily include procedural and substantive aspects to render dispute settlement more flexible for African countries.

My Views on WTO Reform

At the heart of the WTO system is the commitment to the foundational principles of MFN and national treatment. But in a world predicated upon national interest and economic power, the most powerful may not consider multilateral rule-based commitments to be optimal to the achievement of their national interests. One feature of the WTO dispute settlement system is that every Member of the WTO is entitled to have their dispute determined under agreed rules. This is a basic feature of rules-based dispute settlement. The rules, impartially applied, have no regard to the economic power of the parties. The settlement of disputes by recourse to rules of general application yield outcomes that do not depend upon which member is more powerful.
